STATEMENT OF PARTICULARS OF EMPLOYMENT

 

CODING/ROBOTICS/ESPORTS TUTOR/PRINCIPAL TUTOR

 

This Statement dated XXXXXX sets out the main terms of your employment with Code Cadets/Code Cadets London Ltd, (“the Company”), which the Company is required to provide to you under the Employment Rights Act 1996. This Statement together with your verbal offer and the other Employee Policies & Procedures Documents which have been shared with you, form your written contract of employment.

Commencement of Employment:

 

Your employment with the Company commenced on DATE and will end at the end of this current school term or year.

 

No previous employment counts toward your period of continuous employment with the Company.

 

Probationary period:

Your employment is subject to the satisfactory completion of a probationary period of 4 weeks which can be extended to 8 weeks if necessary. During the first month of your probationary period, either you or the company may terminate your employment without notice. After 4 weeks or 8 weeks service, up to satisfactory completion of your probationary period, either party may terminate your employment by giving one week’s notice in writing.

 

Job Title:     

 

The title of the job which you are employed to do is Coding & Robotics/Esports Tutor/Principal Tutor.

 

Place of Work:

 

Your usual place of work is variable around the schools and venues in which we run Code Cadets Coding, Robotics & Esports clubs. They should always be located within a reasonable distance of the town/city in which you live.

 

Pay:   

 

Your basic hourly rate of pay is £XXX per hour. Your final hourly rate of pay is £XXX. Your final hourly rate of pay is higher because it includes holiday pay at the rate of 12.07% (7.2 minutes for every hour worked), plus an additional payment for 15 minutes extra time. These 15 minutes may not always be used and can be used for different purposes: often you will need to be present at the school or venue 5 or 10 minutes before the session start time. Sometimes you may need to stay late for 5 or 10 minutes after the session has finished to tidy the classroom, to return devices for charging or into storage, or to hand children back to their parents. Any unused time can be used as staff development time for reading Code Cadets policies & procedures documentation on the Cadet Hub or practising the coding exercises which you will be using with the club attendees. London clubs only - your final hourly rate of pay may also include an amount towards travel expenses. Your weekly wage is payable on a Friday in arrears by direct bank transfer.

 

Other Employment:

 

It is a condition of your employment that apart from your work within the Company, you do not engage in any other employment, profession, trade or business, directly or indirectly, that has, or could be anticipated to have an adverse effect on the Company, its customers, your ability to carry out your work, or if it would create a conflict of interests or bring the Company or our schools into disrepute.  

 

If you are approached by a parent of a Code Cadets pupil/child and are asked to tutor their child privately, you must make Code Cadets management aware of the request as this has implications for insurance and DBS/PVG arrangements.

 

Deductions:

 

The Company reserves the right to deduct any outstanding monies you owe to the Company from your pay or on termination of employment from your final pay.  This includes any previous error or overpayment, or holiday taken but not yet accrued, the costs of damages or losses attributable to your negligence or dishonesty.

 

Hours of Work:

 

You will be working mostly school term-times, however, you may be offered the opportunity to work at our weekend, Easter and/or Summer Camps. Your normal weekly working hours may be regular (same club/venue each week) but may also vary and may sometimes be zero. If you are offered a regular shift (same school/same time each week) you will be asked to commit to your regular weekly shift(s) and to make yourself available to work right up until the end of term. Your working week will be organised according to a schedule which the Company will notify to you on a weekly or termly basis. You should check the schedule and confirm if you are able to work the shifts allocated. You may be offered other shift(s) at short notice to cover absence. Should a school/venue cancel a club at short notice, you will be paid for the shift if the notice is 24 hours or less.

Your break entitlement will be as follows:

Annual Holidays:

 

The holiday year runs from 1st January to 31st December.

 

You will accrue holidays at the rate of 12.07 % (7.2 minutes) for every hour you work in the current leave year. Your hourly rate of pay includes this amount of holiday pay.

 

Sick Pay:

 

If you are absent from work because of sickness or injury you will be entitled to Statutory Sick Pay, provided you meet the qualifying conditions: You are legally entitled to Statutory Sick Pay (SSP) as long as you have started work with Code Cadets, are sick for 4 full days or more in a row (including non-working days) and earn on average at least £123 per week (before tax).

 

Workplace Pension

 

Your income from Code Cadets is likely to fall below the amount required to become auto-enrolled into our workplace pension scheme (this would need to be above £192 per week). However, since your income is likely to fall below £120 per week, you have the option to pay into our pension scheme yourself (ie you can pay into the scheme, but Code Cadets as the employer, does not need to contribute). Please email admin@codecadets.co.uk for further information if you'd like to pay into the workplace pension scheme yourself. 

 

Period of Notice:

 

Following successful completion of your probationary period, you are required to give one week’s notice in writing to terminate your employment with the Company.

 

Following successful completion of your probationary period, you are entitled to receive the following written notice of termination of employment from the Company:

 

 

End of probationary period but less than two years' continuous service:

 

 

One week

 

 

 

Two years' continuous service or longer:

 

One week for each complete year of service up to a maximum of 12 weeks after 12 years’ service.

 

The Company may exclude these notice provisions in the event of your dismissal for gross misconduct.

 

Where the Company requires you to remain away from work during your notice period (whether you or the Company gave notice), you will be required to comply with any conditions laid down by the Company and whilst on full pay during such time you will not be permitted to work for any other person, firm, client, company or on your own behalf without the Company’s prior written permission.

 

Code of Conduct and Company Rules:          

 

The Company’s Code of Conduct and Company Rules are set out in the Employee Policies & Procedures Files (see Cadet Hub). You must familiarise yourself with them and complete the sign-off document to confirm you have read and understood the content.

 

Disciplinary and Dismissal Appeals:

 

If you are dissatisfied with any disciplinary or dismissal decision taken in respect of you, you may appeal. 

 

Grievance Procedure:

 

The Company encourages employees to settle grievances informally. If, however, you have a grievance relating to any aspect of your employment which you would like to be resolved formally, you must set out the grievance and the basis for it in writing and submit it to the Company Director: admin@codecadets.co.uk. Dress and Appearance:

 

The personal appearance of our employees makes an important contribution to the Company’s reputation and image. For this reason, all customer/child-facing employees are required to attend work each day either in normal smart-casual dress suitable for a working environment which involves regular contact with children, or to wear the Code Cadets t-shirt which you will be provided with. It is important to maintain high standards of personal hygiene. It is not acceptable to come to work smelling of cigarettes and/or alcohol. Employees may be sent home unpaid if this is the case. Some children are asthmatic and are vulnerable to even 3rd party cigarette smoke.

 

Attendance and Late-coming

 

Due to the nature of our work with children, immaculate time-keeping is essential. It is imperative that you are present at the school/venue at the required time as if there are not the correct number of tutors present, in the appropriate tutor to child ratio, this could become a safeguarding issue. If you think that you might be late, you must call or message your manager to alert them as soon as possible. Repeated late-coming will lead to the lost time being deducted from your weekly wage. If you are not able to attend a session, please provide your manager with as much notice as possible to allow them time to make alternative arrangements.

 

Personal Protective Equipment (PPE):

 

It is a condition of your employment that you may be expected to wear any PPE specified by the Company or school as required. This may happen in times of high COVID rates.

 

Devices and Equipment:

 

Company and school devices (eg desktop computers/laptops/iPads) and equipment (eg Lego kits/robotics kits/Playstations etc) are the responsibility of each employee who uses them. You are required to take care of all devices and equipment that you use and ensure that all items are stored in accordance with operating procedures at the end of each session, unless otherwise instructed by the Company or school. Health and Safety and Fire Evacuation Procedures:

 

You are required to gain an understanding of the Company’s and school’s health and safety procedures and observe them. Company procedures are available in the Employee Policies & Procedures Files (on the Cadet Hub) and school procedures should be outlined by individual schools directly to Employees.

 

Smoking:

 

Smoking is strictly not permitted anywhere on school/venue premises.

 

Additional Policies and Procedures:

 

You are required to read and adhere to all additional policies, rules and procedures set down by the Company and relevant to your job and its duties.   You will be required to confirm that you have read these documents and you must ensure that you keep yourself regularly updated with any changes (see Cadet Hub).

 

Confidentiality:

 

You acknowledge that during the course of your employment you will have access to Confidential Information belonging to the Company and the schools in which you work. You shall not at any time during (except in the proper course of carrying out your duties) or after your employment whether directly or indirectly disclose to a third party or make use of any Confidential Information.

 

For the purposes of this section, “Confidential Information” shall include: information relating to the Company’s customers (schools, parents and pupils) and prospective business methods; corporate plans; finances; business opportunities and development projects of the Company; trade secrets including designs, inventions or educational materials belonging to the Company; all or any information relating to the marketing or sales of any past, present or projected product or service of the Company; and any information in respect of which the Company owes an obligation of confidentiality to a third party.

 

Collective Agreements:

 

There are no Collective Agreements affecting the terms of your employment.

 

Changes to Terms of Employment:

 

The Company reserves the right to make reasonable changes to any of your terms and conditions of employment and will notify you in writing of such changes at the earliest opportunity and, in any event, within one month of such changes taking effect.

 

Updating Statement:

 

This Statement updates and takes the place of all previous agreements and arrangements (if any) relating to your employment by the Company.

 

Declaration:

 

I understand that during the course of my employment it will be necessary for the Company to maintain personnel records in relation to my employment. Any information held concerning my employment which is personal data and which is processed by the Company for these purposes shall be processed only in accordance with the Data Protection Act 2018 (GDPR).
